1. Acceptance of Terms

By accessing or using YourNextPlay ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

These terms apply to all users, including players, parents, and guardians.

2. Description of Service

YourNextPlay is a college soccer recruitment platform that helps high school soccer players (women's and men's) discover and connect with NCAA college soccer programs. The Service includes:

  • Player profile creation and management
  • College program discovery and matching
  • Email communication tools for contacting coaches
  • Watchlist and tracking features
  • Recruitment calendar and event management
  • AI-powered school matching and recommendations

2.1 Data Accuracy & Currency

YourNextPlay aggregates and curates publicly available information about NCAA women's and men's soccer programs, including coach contact information, roster data, academic statistics, and program rankings. While we maintain quality controls and refresh data regularly, we do not warrant the accuracy, completeness, currency, or fitness for any particular purpose of any data on the Service. Coach contact information in particular changes frequently due to staff turnover, role changes, and personal email updates. School academic and roster information may lag publicly published updates.

You acknowledge and agree that:

  • You are solely responsible for verifying any contact information before initiating communications
  • YourNextPlay does not guarantee that any email sent through the Service will be delivered, opened, read, or generate a response
  • YourNextPlay does not guarantee any specific recruiting outcome, including but not limited to coach interest, program offers, scholarship offers, or admissions decisions
  • Inaccuracies, omissions, or staleness in data do not constitute a breach of these Terms or grounds for any claim against YourNextPlay

2.2 Third-Party Email Delivery (Gmail Integration)

The Service's email features deliver messages through Google's Gmail API using your personal Gmail account. Gmail is a third-party service operated by Google LLC and is not owned, controlled, or operated by YourNextPlay. All Gmail sending behavior — including delivery, deferral, throttling, spam classification, account warnings, deliverability filtering, and temporary or permanent account suspension — is governed entirely by Google's policies, sender-reputation systems, and operational decisions, and is at Google's sole discretion.

YourNextPlay applies engineering safeguards designed to keep your Gmail account within Google's normal-sender range, including:

  • A conservative daily sending limit of 100 emails per connected Gmail account, set at the floor of Google's documented daily-send range for newly-established Gmail accounts (100–200 per day on a rolling 24-hour basis, per Google's published Gmail sending limits guidance) and well below the 500/day standard-account ceiling
  • Steady inter-email pacing of approximately one email every 30 seconds, as a precautionary measure to reduce the risk of Google rate-limiting
  • Shared-mailbox deduplication to prevent multiple identical emails landing in the same coach inbox
  • Mandatory per-school personalization to avoid mass-blast patterns
  • Automatic retry of transient Google API errors with exponential backoff
  • Circuit-breaker logic that pauses sending if Gmail returns repeated errors

These safeguards reduce — but do not eliminate — the risk of Google flagging, throttling, suspending, or otherwise restricting your account. The 100-per-day limit is an industry-standard safety margin, not a guarantee of acceptance by Google.

You acknowledge and agree that:

  • YourNextPlay does not guarantee that any individual email will be delivered, will avoid Google's spam classification, or will reach the recipient's primary inbox
  • YourNextPlay does not guarantee that your Gmail account will not be throttled, flagged, suspended, locked, rate-limited, or otherwise restricted by Google, whether or not your usage of the Service complied with these Terms
  • Bouncebacks generated by Google's anti-abuse systems may be visible only in your own Gmail inbox (as "mailer-daemon" notifications) and may not be observable by YourNextPlay; we cannot detect or retry such emails automatically
  • If Google places your Gmail account under a temporary 24-hour outbound-sending lockout, attempting to send any email from that account during the lockout (including personal emails sent directly via gmail.com or any other tool) may reset the 24-hour timer per Google's published guidance. You are solely responsible for refraining from outbound sending during such restrictions. YourNextPlay has no ability to detect a lockout state on your Gmail account from our side
  • Your Gmail account's prior sending history, age, reputation, prior spam complaints, recipient response behavior, and other factors outside YourNextPlay's control may affect deliverability and any discretionary action by Google
  • You are solely responsible for maintaining your Gmail account in good standing with Google, including compliance with Google's Terms of Service, Bulk Sender Guidelines, Acceptable Use Policy, and any account-specific notices Google may issue to you
  • YourNextPlay shall have no liability for any consequence of Google's discretionary action on your Gmail account, including but not limited to loss of access to your account, delivery failures, recipient spam-folder delivery, reputational harm, missed recruiting communications, or any other direct or indirect harm
  • YourNextPlay reserves the right to adjust the daily sending limit, pacing rules, and safeguards described above at any time as Google's policies or our operational data evolve, without prior notice

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Age Requirements

You must be at least 13 years old to use this Service. Users between 13 and 18 years old should have parental or guardian consent. By using the Service, you represent that you meet these age requirements.

3.3 Account Security

You are responsible for all activity that occurs under your account. Please notify us immediately of any unauthorized access or security breach.

4. User Responsibilities

When using the Service, you agree to:

  • Provide accurate and truthful information in your profile
  • Use the email features responsibly and professionally
  • Respect college coaches and their time
  • Not misrepresent your athletic abilities or academic credentials
  • Comply with all applicable laws and regulations
  • Not use the Service for any unlawful purpose

5. Prohibited Conduct

You may not:

  • Send spam, unsolicited messages, or excessive emails to coaches
  • Harass, threaten, or intimidate other users or coaches
  • Use automated systems or bots to access the Service
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Impersonate another person or entity
  • Upload malicious code or content
  • Violate any third-party rights, including intellectual property rights
  • Use coach contact information obtained through the Service for any purpose other than the user's own personal college recruitment communications
  • Resell, redistribute, license, or aggregate any coach contact information, school data, roster data, or other Platform data, in whole or in part, in any medium
  • Use the Gmail integration to send commercial, promotional, fundraising, marketing, or non-recruiting communications
  • Solicit, contact, recruit, or otherwise communicate with minors via the Service for any purpose unrelated to the user's own college recruitment
  • Circumvent, disable, or interfere with subscription enforcement, rate limits, paywalls, or other access controls

5.1 Monitoring & Enforcement

YourNextPlay logs basic activity data on the Service — including pages visited, timestamps, and IP addresses — for security and abuse-detection purposes, as further described in our Privacy Policy. We use this data to detect violations of this Section 5 and of Section 7.2 (Restrictions on Platform IP), including but not limited to automated scraping, bulk data extraction, circumvention of rate limits, and other unauthorized access patterns.

We reserve the right, at our sole discretion and without prior notice, to (a) suspend or terminate your account, (b) revoke access to the Service, (c) cancel any active subscription, and (d) pursue legal remedies — including injunctive relief and damages — for any violation of this Section 5 or of Section 7.2. Termination for violation of this Section 5 or Section 7.2 does not entitle you to a pro-rated refund beyond the cancellation policy in Section 10.4, and YourNextPlay may, in its sole discretion, refund part or all of unused subscription time as part of an account termination for cause without thereby admitting liability.

Continued use of the Service following a written warning of prohibited conduct constitutes a material breach of these Terms.

6. Gmail Integration

If you choose to connect your Gmail account:

  • You authorize us to send emails on your behalf when you initiate email requests
  • Emails will be sent from your Gmail address
  • You are responsible for the content of emails you send
  • You may disconnect your Gmail account at any time
  • You agree to comply with Gmail's terms of service and acceptable use policies

7. Intellectual Property & Proprietary Rights

7.1 Ownership

The Service, including but not limited to all software, source code, algorithms, data models, user interfaces, designs, text, graphics, school and coach databases, curated datasets, matching algorithms, email templates, and all other content and materials available through the Service (collectively, "Platform IP"), is the exclusive property of YourNextPlay and is protected by United States and international copyright, trademark, trade secret, patent, and other intellectual property laws. The compilation, organization, and presentation of school, coach, roster, and program data constitutes a protectable work of authorship and proprietary database.

7.2 Restrictions

You may not, directly or indirectly:

  • Copy, reproduce, modify, adapt, translate, or create derivative works based on the Service or any Platform IP
  • Reverse engineer, disassemble, decompile, or otherwise attempt to discover the source code, algorithms, or data structures of the Service
  • Scrape, crawl, index, harvest, or otherwise systematically extract data from the Service, whether by automated means (bots, spiders, scrapers) or manual collection
  • Reproduce, mirror, or redistribute any portion of the school database, coach contact information, roster data, program rankings, or any other curated dataset, in whole or in part, in any medium
  • Use the Service to build, train, or improve any competing product, service, or dataset
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Sublicense, sell, resell, transfer, assign, or distribute access to the Service or any Platform IP

7.3 User Content

You retain ownership of content you submit (profile information, custom templates, notes). By submitting content, you grant YourNextPlay a non-exclusive, worldwide, royalty-free license to use, display, store, and process that content solely for the purpose of providing the Service.

7.4 Feedback

Any suggestions, ideas, or feedback you provide about the Service may be used by YourNextPlay without restriction or compensation.

7.5 Enforcement

Any unauthorized use of Platform IP constitutes a material breach of these Terms and may violate copyright, trademark, trade secret, and other laws. YourNextPlay reserves the right to pursue all available legal remedies, including injunctive relief, actual and statutory damages, and recovery of attorney fees.

8. Database & Data Rights

The databases accessible through the Service represent substantial investment in collection, verification, curation, and organization. You acknowledge that:

  • The selection, coordination, and arrangement of data constitutes original works of authorship protected by copyright
  • The databases are protected trade secrets reflecting proprietary methods of collection, scoring, and quality assessment
  • Unauthorized extraction or reutilization of a substantial part of the database contents is prohibited
  • Systematic or repeated extraction of insubstantial parts of the database that cumulatively amount to a substantial part is also prohibited
  • These protections apply regardless of whether the individual data points are publicly available from other sources — the curated compilation and enriched dataset are proprietary

9. Competitive Use Prohibition

You may not use the Service, or any information obtained through the Service, to directly or indirectly develop, enhance, or operate a product or service that competes with YourNextPlay. This includes, without limitation, using the Service to:

  • Build or populate a competing recruiting platform or database
  • Compile coach contact information for use outside the Service
  • Reverse-engineer our matching, scoring, or recommendation systems
  • Benchmark the Service for the purpose of building a competing offering

Violation of this section entitles YourNextPlay to immediate account termination and pursuit of injunctive relief without the requirement of posting bond.

10. Subscription & Billing

10.1 Fees

Access to premium features requires a paid subscription at the rate displayed at the time of purchase. All fees are in U.S. dollars.

10.2 Billing Cycle

Subscriptions are billed annually. Your subscription will automatically renew unless canceled before the renewal date.

10.3 Cancellation

You may cancel your subscription at any time through your account settings or via the Stripe-hosted billing portal. Upon cancellation:

  • Your subscription will not automatically renew at the end of the current billing period
  • You retain full access to all paid features through the end of the period you have already paid for
  • Cancellation alone does not entitle you to a refund of any portion of fees previously paid
  • You may resume a canceled subscription before the period ends, and your renewal will continue normally

10.4 Refund Policy

All subscription fees are non-refundable, except as follows:

  • 7-day refund window for new purchases. If you request a refund within seven (7) calendar days of your initial subscription purchase AND have not made significant use of the Service, YourNextPlay will issue a full refund. "Significant use" means having sent five (5) or more emails to coaches, OR having added ten (10) or more schools to your watchlist, OR having generated saved matches via the Match Assistant.
  • Demonstrated technical failure. At YourNextPlay's sole discretion, refunds may be issued in cases of demonstrated, sustained technical failure that prevented platform use for a substantial portion of a billing period.
  • Where required by applicable consumer protection law in your jurisdiction.

All refund requests must be submitted in writing to support@yournextplay.ai and must include the email address associated with the subscription.

How refunds are paid out. All YourNextPlay payments are processed by our payment provider, Stripe. YourNextPlay does not directly hold or move your funds. Once you complete a purchase, the funds are first held by Stripe and typically take several business days to settle and become available to YourNextPlay. When a refund is approved, YourNextPlay initiates the refund through Stripe. The full timeline you should expect is: up to two (2) business days for YourNextPlay to review and approve your request after you email us; up to ten (10) business days for YourNextPlay to initiate the refund through Stripe after approval; and an additional five to ten (5–10) business days for Stripe to finalize the refund and for the funds to appear in your bank account or on your card statement, depending on your bank or card issuer. In total, please allow up to several weeks between submitting a refund request and seeing the funds in your account. If a refund has not appeared after that period, email support@yournextplay.ai and we will follow up with Stripe on your behalf.

Renewal payments (i.e., second-year and subsequent automatic renewals on multi-year plans are non-refundable except where required by law. To avoid an unwanted renewal, cancel before the renewal date as described in Section 10.3.

When a full refund is processed, your access to the Service will be revoked immediately upon refund completion. Partial refunds, when granted at YourNextPlay's discretion, do not affect your access rights for the remainder of the billing period unless the underlying subscription is also canceled.

Not grounds for refund. The following are not, on their own, grounds for a refund: (a) change of mind after the 7-day window or after significant use; (b) the absence of any specific recruiting outcome (coach replies, scholarship offers, interviews, official visits, roster spots, admission, or similar) — the Service provides tools and information, not guaranteed outcomes; (c) individual coaches choosing not to respond; (d) preference for a competing tool or free alternative discovered after purchase; (e) account suspension under these Terms; or (f) failure to use the Service when it was available and functioning. 10.5 Price Changes

We may change subscription pricing with 30 days' notice. Price changes will take effect at your next renewal.

10.6 Payment Processing

Payments are processed by Stripe, Inc. Your payment information is handled directly by Stripe and is not stored on our servers. Your use of Stripe is subject to Stripe's terms of service.

11. Third-Party Services

The Service may integrate with third-party services (such as Google and Stripe). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • You will receive responses from college coaches
  • You will be recruited by any college program
  • College program information is always accurate or up-to-date

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOURNEXTPLAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, RECRUITING OPPORTUNITIES, SCHOLARSHIP OFFERS, ADMISSIONS OUTCOMES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF YOURNEXTPLAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL YOURNEXTPLAY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO YOURNEXTPLAY IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you in full. In such jurisdictions, YourNextPlay's liability is limited to the maximum extent permitted by applicable law.

14. Indemnification

You agree to indemnify and hold harmless YourNextPlay and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

15. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. You may also delete your account at any time.

Upon termination, your right to use the Service will immediately cease.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

17. Dispute Resolution & Governing Law

17.1 Informal Resolution First

Before bringing any formal claim, you agree to first attempt to resolve the dispute informally by contacting support@yournextplay.ai with a written description of the dispute. YourNextPlay will attempt in good faith to resolve the dispute within thirty (30) days of receipt.

17.2 Binding Individual Arbitration

ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICE, OR THE RELATIONSHIP BETWEEN YOU AND YOURNEXTPLAY THAT CANNOT BE RESOLVED INFORMALLY SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS CONSUMER ARBITRATION RULES, EXCEPT AS PROVIDED IN SECTION 17.5 BELOW.

The arbitration shall be conducted in the State of California or, at your election, in your home state, by a single neutral arbitrator. The arbitrator's decision shall be final and binding, and judgment on the arbitration award may be entered in any court of competent jurisdiction. Each party shall bear its own costs and attorney fees, except as the AAA Consumer Arbitration Rules provide otherwise.

17.3 Class Action & Jury Trial Waiver

YOU AND YOURNEXTPLAY EACH WAIVE ANY RIGHT TO PARTICIPATE AS A REPRESENTATIVE OR MEMBER OF ANY CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED PROCEEDING, OR REPRESENTATIVE PROCEEDING. YOU AND YOURNEXTPLAY EACH WAIVE ANY RIGHT TO TRIAL BY JURY. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY ONLY.

17.4 Time Limit on Claims

Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the cause of action arose, or it shall be permanently barred.

17.5 Exceptions

Either party may bring an individual action in small claims court for a qualifying dispute. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or to prevent unauthorized access to or use of the Service.

17.6 Governing Law

These Terms and any dispute arising out of or relating to them shall be governed by the laws of the State of California, without regard to its conflict of law provisions, except that the Federal Arbitration Act governs the interpretation and enforcement of Section 17.2 (Binding Individual Arbitration).

17.7 Severability

If any portion of this Section 17 is found unenforceable by a court of competent jurisdiction, that portion shall be severed and the remainder shall remain in full force and effect. If the class action waiver is found unenforceable, then the entirety of Section 17.2 (Binding Individual Arbitration) shall also be severed, and disputes shall be resolved in court as provided in Section 17.6.
